Can we both buy a new home through the same estate agent?

Yes. These are different homes. With each purchase, we represent the interests of the buyer we are guiding.

Do we both have to agree to the sale?

Yes, if the house belongs to both of you. You decide together on the asking price and on an offer, and you both sign the purchase agreement.

What if one of us wants to stay in the house?

Then that partner must be able to bear the mortgage alone and the bank must release the other from joint and several liability. A mortgage adviser can calculate whether that is feasible.
